Murder and the Laws in Florida

According to Florida Statutes first degree homicide is one of 2 acts. It is either the premeditated killing of another human being or the killing of another human being during the commission or attempted commission of a felony. Some of these felonies include trafficking of illegal substances, home invasion robbery, aggravated child abuse, elder abuse, robbery, burglary, kidnapping and arson.

First Degree Murder

First degree murder in Florida occurs when an individual commits an enumerated felony that results in the death of another or takes the life of another person through premeditation. A first degree murder, either felony or premeditated is punishable by death or by life in prison without the possibility of parole.  Those are the only 2 possible penalties. 

Second Degree Murder

Murder in the 2nd degree is a 1st degree felony, punishable by life in prison.  Second degree murder involves the murder of a human being without premeditation, by an act imminently dangerous to another and evincing a depraved mind regardless of human life.
